General Terms & Conditions
These Terms & Conditions and notices contained herein govern your use of the ElectroSuperMarket service and website. By using, visiting, or browsing the ElectroSuperMarket website(s), you accept and agree to be bound by these Terms & Conditions. If you do not agree to these Terms & Conditions, you should not use the ElectroSuperMarket service or website. These Terms & Conditions apply to all users, members and non-members of the ElectroSuperMarket service or website.
ElectroSuperMarket reserves the right, from time to time, with or without notice to you, to change these Terms & Conditions in our sole and absolute discretion. This page is the most updated version of these Terms & Conditions which can be viewed by clicking on the links that direct you to the Terms on the ElectroSuperMarket website. Your use of the ElectroSuperMarket website or continued use of our service after changes are made means that you agree to be bound by such changes.
ElectroSuperMarket has the right at anytime to introduce or change current membership fees and or service charges, we will advise of any such change by email. At the time of writing, there is no charge for membership of the ElectroSuperMarket website. You may close your account with ElectroSuperMarket at anytime by informing us in writing, or email. We reserve the right to terminate or suspend your account at anytime without giving notice to you.
You may not share your account with any third party or provide them your password. Should you decide to share your account with any third party then you take full responsibility for their actions and you will be liable for any losses or errors that cause a financial or stock shortfall on your account. If you find that your account is being accessed without your consent you are a victim of identity theft and you should notify customer service as soon as possible as well as your local law enforcement agency. ElectroSuperMarket is not obligated to compensate members/account holders for losses of funds due to your account being used without your specific authorisation.
We reserve the right to change prices at any time. Due to possible information misrepresentations, we may correct typographical and printing errors related to prices at any time. All customers should be aware that product prices can and do fluctuate due to market movements and stock availability.
In the event that a product is not available after you have placed an order, we will inform you by email as quickly as possible so that you may cancel your order. An order made for articles not in stock may be the object of a longer period of delay or a cancellation.
All orders are subject to a delivery period of 6-21 days from the date we process your payment.
See below for Terms 1, 2, and 3 as specified on each individual product listing. Only the terms specified on the listing page apply to that item, and as such any subsequent orders made for that item.
Terms 1
All products with ‘Terms 1’ specified come with a 12 month warranty.
This means if there is a quality defect that causes the device to be unacceptable for sale or unusable during the 12 months after dispatch, we will accept a return and either repair the item, replace the item with an identical new item, replace the item with an equivalent item that you accept, or offer credit or a refund.
Any returns must be discussed with ElectroSuperMarket in advance, and authorized so they are sent with the correct paperwork.
All returned products must be sent together with the original packaging and accessories unless an exception is agreed in advance.
In the event of any returned goods where you are requesting a repair / replacement / refund under the warranty, your shipping costs returning the products to the ElectroSuperMarket Supplier are payable by you, and cannot be compensated by ElectroSuperMarket.
Physical damage to a product caused by the user invalidates the warranty. Opening products up, e.g. to repair or modify components, invalidates the warranty. Flashing the firmware or using non-approved software invalidates the warranty.
Terms 2
All products with ‘Terms 2’ specified benefit from a guarantee of conformity for one year as of the date of delivery for the goods sold.
The costs arising due to the return of the goods will be refunded if the guarantee of conformity is applicable to the returned goods. The product should be returned by the national postal service. No parcel should be sent to the ElectroSuperMarket stated address. When your product is returned, ElectroSuperMarket will take care of ensuring that it is repaired or replaced. Any returned product must be accompanied by a copy of your invoice, the guarantee certificate (in the box) and a returns coupon. The guarantee does not apply when malfunctioning results from damage caused by exterior elements, accidents (notably electrical, physical damage, misuse etc.) any actions that are against the advice and instructions given in the product manual.
The guarantee conditions also exclude all products that have been modified or repaired by the customer or a non-authorised repair centre. In case where the warranty is not applicable for the reparation, the manufacturer will quote a price for repair.
The guarantee does not cover:
-the replacement of consumables (batteries, lights, fuses, aerials, headphones, microphones, recording heads or playing heading ...)
-the irregular usage or non-conforming usage of products. Please consult the instruction manual delivered with your product. -malfunctioning due to usage with accessories (power cables etc)
-malfunctioning due to repairs effected by non-authorized personnel
-malfunctioning due to external causes
-malfunctioning due to non-conforming usage of the product (professional usage, collective usage etc)
ElectroSuperMarket cannot be held responsible for the warranty should the manufacturer not honour the guarantee.
Products must be returned in perfect condition, carefully packaged in their original state, with all of their accessories (e.g. CD-ROM, cables, user guides, etc.) and without any modifications to their reference and serial numbers. They must have their labels intact, along with any stamps or marks required for resale. Products must be returned to the address specified by ElectroSuperMarket in the event of a product return.. Products must also be accompanied by a returns coupon and be sent by recorded delivery (e.g. transporter), regardless of whether they are the subject of a refund or a return. If a product is returned without prior written authorisation from ElectroSuperMarket, it will be automatically sent back to the Client at their expense.
Terms 3
All products with ‘Terms 3’ specified carry a seven day limited warranty. All products with ‘Terms 3’ specified are original and brand new. Manufacturer’s warranty is normally 12 months (please check this with your local service centre). The manufacturer may refuse to honour the 12 months warranty if the product is imported; this is at the manufacturer’s discretion.
The limited warranty covers the following faults described below.
DOA (Dead on Arrival) implies that the product either cannot be turned on or be ready in use after taking out of the box. Buyer must report this situation to ElectroSuperMarket within 48 hours of receipt. If the item is not tested or examined by the buyer within the first 48 hours after the goods are received, the DOA returned policy would not be valid.
No further exception will be considered about the time issue. The 48 hours period starts from the time recorded as "delivered" in the courier service's tracking system.
ElectroSuperMarket will replace or repair a DOA item, In the event that a replacement or repair cannot be made due to product unavailability or any other technical reason, ElectroSuperMarket will refund the buyer in full including the original shipping charges. A repair order may take up to 14 business days starting from the day when the ElectroSuperMarket supplier received the defective unit. ElectroSuperMarket has the right to make the final decision on whether a replacement or a repair process should be issued under any circumstances or situation.
Neither network dependent features nor firmware related issues will be covered by our limited warranty repair coverage, regardless if the problem is permanent or not. Please refer to our product compatibility section regarding on the description of network dependent features. ElectroSuperMarket has the right to determine whether the issue pointed out by the buyer is a network dependent feature or not. ElectroSuperMarket has the right to make the final decision on whether a repair process should be issued under any circumstances or situation.
Under any circumstances, ElectroSuperMarket reserves the final rights to approve any DOA replacement or a warranty coverage repair. ElectroSuperMarket also has the right to make the final decision on whether the issue pointed out by the buyer is considering a defect or not. In the event that a replacement or repair is not granted to the buyer, ElectroSuperMarket will send back the product back to the buyer; In this case it is the duty of the buyer to cover shipping costs.
The repair process by ElectroSuperMarket may take up to 14 business days upon item being received from the buyer.
All returns must be approved by ElectroSuperMarket. A duly completed returns form must be completed by the buyer and emailed to ElectroSuperMarket for approval, Returned items without an approval form from ElectroSuperMarket will not be processed. Any shipping and handling expenses on returns without a duly completed approval form will be the responsibility of the buyer.
Upon receiving the return from the buyer, ElectroSuperMarket will examine and test for the defect. If ElectroSuperMarket cannot reproduce the same fault indicated by the buyer, the return will not be accepted.
All return shipments from ElectroSuperMarket will be via ground shipping method or the equivalent subject to be determined by ElectroSuperMarket.
In the event of returning the product, buyer is fully responsible for the product's safe return to us. Item must be received within 7 days and by insured post.
The return merchandise should include the RMA number that was issued by the ElectroSuperMarket, order number, full name, shipping address, contact phone number, and the reason for return. All accessories and manuals must be included inside the package as it was originally received by the buyer. Return merchandise should be boxed and well packed. Any missing parts, damaged items or inappropriate information will not be accepted. ElectroSuperMarket will have the right to dispose of any unidentified return aged over 14 days without notifying the buyer.
No replacement will be issued on those unidentified returns once it has been disposed of. Buyer is responsible for the returns shipping cost. The standard replacement shipping by ElectroSuperMarket will be ground shipping / Air Mail or the equivalent subject to be determined ElectroSuperMarket.
ElectroSuperMarket is not responsible for any network dependent features and firmware related issue. Examples on network dependent features are MMS / GPRS / WAP / SMS / Messaging / Voicemail Indicator / Data Transfer / Network Frequency as well as any other device operations that have interaction with their service providers. Buyers are responsible for ensuring the product's compatibility with their network operator / service provider.
ElectroSuperMarket has the right to make the final decision on whether a feature is considered network dependent or not. ElectroSuperMarket has the right to make the final decision on whether an issue is firmware related or not. Buyer should be aware that network dependent features and firmware issues are not covered by our limited warranty coverage. Please refer to our limited warranty coverage section for details.
Buyers should also be aware that the some products might not be primarily intended for use in your country or region. Therefore, the language specification on the device and manual might or might not fully support the language of your choice. In the event that an English manual is not available in the particular version that we shipped out, ElectroSuperMarket does not have any obligation to provide a copy of an English manual to the buyer. However, we do try our best to provide a printed English manual in most cases or send English manuals via email.
Since the products that ElectroSuperMarket sell might not be primarily intended for your country or region, the product configuration and the related accessories might not be suitable or compatible in your country or region. ElectroSuperMarket will not be responsible for any incompatibility of the product and its accessories in your region or country.
Language version, firmware version and colour are shipped on a random basis unless prior arrangement is made by the buyer. Once item is shipped, no exchange will be granted on language version, firmware version and colour choice. It is the buyer's responsibility to ensure that they select the correct model, colour, firmware on time of order. For mobile phone purchases, the keypad will support both alphabetic and numeric characters. However, some versions or models possess additional language characters. These could be in Chinese, Arabic, or some other languages.
ElectroSuperMarket will not be liable for any personal injury, physical injury, and damage caused by the products that we sell.
For safety handling and operation on the product, please consult the instruction manual that comes with the product or contact the manufacturer directly. Any product recalls by the manufacturer will not be handled through ElectroSuperMarket.
Buyers should contact the manufacturer directly for any related questions or enquiries.
Terms 4
If for any reason you are not satisfied with a product, please contact us before sending the item back. We will need to send you proper instructions on how and where to return the item(s).
We guarantee that all products you buy are free of defects or you may return it immediately for a new replacement. If your item was damaged during shipment, please contact us and we will send you proper instructions on how to file a claim.
If you are not satisfied with your item, you may return it to us within a period of 30 days. For orders shipped to the UK, the period allowed for returning an item is 3 days. Shipping cost is non-refundable for undelivered, unclaimed, returned and refused packages, unless we made an error.
When returning an item, please make sure to use all the original packaging wherein the shipment has come to you, with all accessories and owners manual. Do not write, stick or glue anything on the product package that can damage the package. You can include a separate letter to explain your returning reason with a reference to the RMA number.
There will be a 50% restocking fee on non-damaged items that are returned in damaged package.
If a shipment is refused at the door or cannot be delivered for whatever reason we will deduct these fees from the refund which will be added to the normal restocking fee.
ALL RETURNS WILL REQUIRE A RMA NUMBER. A 50% RESTOCKING FEE WILL BE APPLIED IF AN ITEM IS RETURNED WITHOUT A RMA NUMBER.
RMA numbers can be requested by emailing ElectroSuperMarket.
Orders that are shipped outside the supplier country might incur custom and sales taxes. It is the buyer's responsibility to pay for these additional fees at the time of delivery. If a shipment is refused we will deduct these fees from the refund which will be added to the normal restocking fee.
